Terms of Service

These Terms of Service ("Terms") govern your access to and use of agenticsocial (the "Service"), a platform for building, scheduling, and running automated social-content pipelines, operated by agenticsocial ("we," "us," or "our"). By creating an account or using the Service at agenticsocial.co, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

2. The Service

The Service lets you connect your own servers and third-party accounts, configure content pipelines and templates, and schedule and publish content. You are responsible for the servers you enroll, the credentials you add, and the content your pipelines generate and publish.

3. Your responsibilities and acceptable use

• You will comply with all applicable laws and with the terms and policies of any third-party service you connect (including each social-media platform's rules on automation and posting).
• You will only connect servers, accounts, and credentials that you own or are authorized to use.
• You will not use the Service to publish unlawful, infringing, deceptive, harassing, or harmful content, or to send spam.
• You will not attempt to disrupt, reverse engineer, gain unauthorized access to, or overload the Service or its infrastructure.
• You are solely responsible for the content you create, schedule, and publish through the Service.

4. Third-party services

The Service integrates with third-party providers (for example, social-posting, image, and AI providers). Your use of those providers is governed by their own terms and privacy policies. We are not responsible for third-party services, and your use of API keys and accounts you connect is at your own risk and subject to those providers' rules and rate limits.

5. Fees

Some plans or provisioning modes may be offered for a fee, including infrastructure we provision on your behalf. Where fees apply, they will be disclosed before you incur them. You are responsible for any costs charged by third parties (such as your own cloud provider or API providers) when you use the Service.

6. Your content

You retain ownership of the content and configurations you create. You grant us a limited license to host, process, and transmit that content solely to operate the Service and perform the actions you request. You represent that you have the rights necessary to use and publish the content you submit.

7. Intellectual property

The Service, including its software, design, and branding, is owned by us and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or to copy or resell the Service.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ends, and we may delete your data as described in our Privacy Policy.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that scheduled content will always publish successfully.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us for the Service in the twelve months before the claim, or USD 100.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, and expenses arising out of your content, your use of the Service, your connected accounts and servers, or your violation of these Terms or applicable law.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in California.
